Welcome to the GearBlocks Affiliate Program! By signing up as an affiliate, you agree to comply with the following terms and conditions. These terms are designed to protect both parties and ensure a successful and transparent partnership.
1. Enrollment in the Program
To enroll in the GearBlocks Affiliate Program, you must contact GearBlocks and request access to the affiliate program. We reserve the right to reject applications for any reason, including social media content or websites that:
- Promotes sexually explicit materials.
- Promotes violence or discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age.
- Violates intellectual property rights or promotes illegal activities.
2. Affiliate Responsibilities
As an affiliate, you agree to the following responsibilities:
- Promotional Activities: You may promote GearBlocks through legal and ethical marketing practices only. You are prohibited from misleading or false advertising.
- Use of Affiliate Links: You will only promote products or services using provided affiliate links. Any commission is tracked through these links.
- Compliance with Laws: Affiliates must comply with all applicable laws, regulations, and guidelines (including FTC disclosure requirements).
3. Commissions and Coupons
- Commission Rate – No Coupon: Affiliates will earn a commission of 10% on qualifying purchases made through affiliate links when no coupon is applied.
- Commission Rate with Coupon: Affiliates will earn the difference between 15% and the coupon value. Coupon shall not exceed 15%. The value of the coupon shall be predetermined by Gear Blocks and the affiliate before the campaign begins. The affiliate earns commission on the value after the coupon is applied.
- Payouts: Commissions will be paid out once a quarter. GearBlocks will send the affiliate a statement for the quarter. The affiliate shall then invoice GearBlocks using a payment gateway like PayPal, Quick Books, Venmo or other means that can be paid by credit card. If this is not possible GearBlocks may make other arrangements such as check, or bank transfer, but only as a last resort.
- Non-qualifying Purchases: Refunds, fraudulent transactions, and chargebacks will not qualify for commissions.
4. Cookie Duration
The affiliate cookie will last for 30 days. If a user purchases a product within this period after clicking your link, you will receive a commission.
5. Affiliate Restrictions
Affiliates are prohibited from:
- Using paid ads (e.g., Google Ads, Facebook Ads) to promote affiliate links.
- Making false claims about the products or services.
- Any activity that involves fraud or spam, such as generating fake leads.
6. Termination
Either party may terminate this agreement at any time by providing written notice. Upon termination:
- All affiliate links must be removed from your site or social media channels.
- No future commissions will be paid for purchases made after termination.
7. Modification of Terms
GearBlocks reserves the right to modify or update these terms and conditions at any time. Affiliates will be notified of significant changes via email or the affiliate dashboard.
8. Liability Limitations
GearBlocks will not be liable for indirect, incidental, or consequential damages (including lost profits) arising out of the affiliate agreement or any associated marketing efforts.
9. Governing Law
GearBlocks is owned and operated in California. This agreement shall be governed by the laws of California. Any legal actions will be handled in the courts located in California.
10. Acceptance of Terms
By participating in the GearBlocks Affiliate Program, you agree to these terms and conditions in their entirety.
